Many of us feel reluctant to make plans for after our death, but we all want to make sure that our money is taken care of and our families are provided for if we are not there for them.

By making a Will you make sure that your wishes and not someone else's are carried out in the future. If you die intestate (without making a will) the the Government decides how your estate is divided.

When buying, selling or re-mortgaging a property it is an ideal time for you to think about making a Will. That's why it makes sense to choose me as I act for Goldsmith Williams Solicitors. Why is it so important to make a Will?

1. Two thirds of the population dies without making a Will. This results in their loved ones being left with unnecessary problems at a difficult time. The costs of dividing up your Estate will be more than the cost of making a Will beforehand.

2. Your Will allows you to say what should be done with your money and possessions and is a record of your instructions of how your Estate will be distributed when you die.

3. If you die Intestate your money and possessions will be divided up by the Government in accordance with the Rules of Intestacy. Some people may assume that everything will automatically go to their husband or wife and children. This is not always the case.

4. If you live with someone but are not married to them, that person will not be entitled to anything (unless a property is owned equally as Joint Tenants) unless stated so within your Will.

5. If you have been married or divorced since you last made your Will it may not be legally binding and you will need to consider making a new one.

6. If you have children aged 17 or under, your Will is the best place to name their legal guardians and make financial arrangements for them.

7. If the total value of your Estate exceeds the current tax threshold you will have to pay inheritance tax at the rate of 40%. By preparing a Will there are ways you can minimise the amount of tax to be paid.
